Roger Hannah acted on behalf of a local Ashton Mosque in their compensation claim resulting from the Ashton Town Centre CPO.
As a Place of Worship does not have a market for that particular use it is entitled to ‘equivalent reinstatement’ under Rule 5 of Section 5 of the 1961 Land Compensation Act. Effectively, therefore they are entitled to the construction of a new build mosque premises together with other costs associated with their relocation.
Roger Hannah have been engaged in detailed negotiations with Tameside MBC involving the identification of a suitable alternative site, obtaining of planning permission and agreement with the local authority for the cost in the construction of a new mosque premises.
