Roger Hannah & Co represented Clear Channel UK Limited, the outdoor media company. They leased 6 advertising sites across East London affected by the London Olympics regeneration. The acquiring authority tried to dismiss the claim for compensation on the basis that no planning consent was in place for the advertising hoardings.
We undertook extensive research on the historic planning use to try and prove 10 years continuous use. Ultimately we took the decision to prove the position by making a Section 17 application, to establish the planning position with the local authorities concerned. We worked with our client to obtain Section 17 applications resulting in 6 certificates being obtained. Once we proved the planning position we could then re commence negotiations to settle the compensation. This resulted in London Development Agency paying out fair compensation to our client. The negotiations were protracted but ultimately successful.
